GENERAL PROPERTIES

1. The Regulations define the rules of making purchases by the buyer in the store operated by the seller.

2. The seller is Sports Trade, which operates under the domain tnnisballmachine.eu and is based in Poland, 59-700 Bolesławiec at Staroszkolna 6B/6

3. The Buyer may only be an adult natural person or entrepreneur conducting business activity in a form admissible by law.
 
II. SUBMISSION OF ORDER

1. In order to conclude a sales agreement, it is necessary for the buyer to create an order through the form located on the website www.tennis.pl.

2. The Seller reserves that in the event that on the above mentioned form customer data will be incomplete or the seller will have doubts as to their accuracy, the order will not be executed.

3. Correct delivery of the e-mail and acceptance by the seller of the order is confirmed by the seller sending the confirmation to the buyer to the e-mail address indicated by him.

4. If the buyer wants to cancel the order, he must contact the seller on the phone number +48 721-777-521  or by e-mail to: info@tennismballachine.eu

5. The Seller reserves that the order can not be canceled if the product has already been sent to the buyer.

6. In the absence of goods in the warehouse of the seller or a significant change in prices, the seller will contact the buyer to individually determine the date of the contract or to propose another product available for purchase.

7. All prices given on the tennisballmachine.eu website are gross prices and include VAT tax.

8. The prices are binding at the time of placing the order, however in special cases they may change, eg in a situation where the goods come from abroad and are converted at the exchange rate or the importer did not update the prices of last year.

9. The Seller reserves the right to change the prices of products placed in the domain www.tennis.pl, placing and canceling promotional offers.

10. The Buyer may place orders 24 hours a day, 7 days a week.

11. In the event of any disputes, the provisions of applicable Polish law shall apply.

III. DELIVERY, COSTS AND TIME OF IMPLEMENTATION, FORMS OF PAYMENT

1. The order realized by the seller is sent via DPD or UPS  courier company.

2. The Seller sends the purchased goods with cash on delivery or after the buyer pays the prepayment to the seller's bank account.

3. The cost of the insured DPD shipment:

up to 30 kg is delivery for free - if you pay by bank tronsfer  or EUR 100 - if pay COD (cash on delivery)

4. The Seller takes full responsibility for the shipment carried out by DPD.

5. The cost of delivery is borne by the buyer.

6. The estimated delivery time, i.e. the receipt of the goods by the buyer, is up to 5 business days.

7. The seller is not responsible for delays in delivery of goods for which he is not at fault.

8. The decision on choosing the carrier belongs to the client.

9. The seller provides personal collection of goods at its headquarters from Monday to Friday from 10.00-17.00

10. The buyer has the right to choose the payment that applies to the seller.

11. In the absence of the buyer, the courier leaves an advice with information on when and where to pick up the parcel. Delivery of the advised parcel is made free of charge. Each subsequent delivery attempt is payable. These costs are borne by the buyer. In the case of unsuccessful delivery attempts, the goods are returned to the seller's warehouse and the customer is charged with delivery costs.

IV. COMPLAINTS

1. The condition for the complaint of the shipment of goods in the event that the packaging bears signs of damage or attempts to open, is made in the presence of a representative of the courier company or a representative of the post a protocol description of the damage and refusal to accept the goods.
In this case, the buyer is obliged to immediately notify the seller about the situation.

2. Defective or factory damaged goods are exchanged for new ones, provided that the damage has been reported within 5 working days from the date of delivery.

3. The costs of sending the goods free from defects shall be covered by the seller.

4. The condition for considering the complaint by the seller is enclosing to the complaint a fiscal receipt or a copy of the invoice.

5. In the event of an unjustified complaint or damage to the goods due to the fault of the user, all costs shall be borne by the buyer.

6. The Parties undertake to settle any disputes arising during the complaint procedure in the first place through out-of-court negotiations.

Description of the complaint procedure:

     The Buyer may submit complaints to the Seller regarding the concluded Agreement at info@tennismachine.eu or in writing to the address of the Seller of Trade Trade ul. Staroszkolna 6B/6, 59-700 Bolesławiec, Poland. A correctly submitted complaint should contain at least:

        1. first name, surname, address, e-mail address of the Buyer,
        2. the conclusion of the Agreement constituting the basis for the complaint,
        3. the object of the complaint, indicating the Buyer's request,
        4. all circumstances justifying the complaint.

If the data or information provided in the complaint need to be supplemented, before considering the complaint, the Seller asks the complainant to supplement it in the indicated scope.
     The seller recognizes the complaint within 14 days from the date of its receipt in the correct form.
     The response to the complaint is sent to the e-mail address provided by the Buyer or to the traditional postal address.

The consumer's right to withdraw from the contract:

Within 14 days of receipt of the purchased item or - in the case of services - conclusion of the contract, the Buyer (consumer) may withdraw from the contract without giving any reason. In this case, the Seller shall return all payments received from the Buyer.
In order to withdraw from the contract, a relevant declaration of will must be submitted to the Seller by e-mail to: info@tennismachine.eu. The buyer may use the model withdrawal from the contract specified below.

The cost of returning the item in the event of withdrawal from the contract:

In the event of withdrawal from the Agreement, the Seller shall not bear the cost of returning the Goods.

Sports Trade  declares that he undertakes to deliver the item (good) without hidden defects, excluding the defects indicated in the sale offer.

VI. FINAL PROVISIONS

1. The data of the shop's customers will be used only to fulfill orders and to conduct sales statistics. will
stored in a manner that prevents access to third parties in accordance with the Act of 29 August 1997 on the protection of personal data, Dz. U No. 133 item 883.

2. We reserve the right to cancel the order without giving a reason.

3. The buyer has the right to return the ordered goods within 14 days without giving a reason.

4. The parties undertake to resolve any doubts arising from the application of the regulations in an amicable way. In the event of the amicable settlement being exhausted and the need to conduct court proceedings, the Polish common court will be competent.

5. In matters not covered by these regulations, the provisions of Polish law shall apply, in particular the Civil Code.
